1. Acceptance of Terms
By accessing and using the Ayata Homes website (the "Site") or engaging our interior design services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Site or our services.
These Terms apply to all visitors, clients, and users of the Site and our services.
2. Services Offered
Ayata Homes provides professional interior design and related services including, but not limited to:
- Full Home Interior Design
- Modular Kitchen Design
- Wardrobe & Storage Solutions
- False Ceiling & Lighting Design
- Turnkey Renovation
- Personalised Interior Styling
The scope, timelines, and costs for each project are defined in a separate written agreement (proposal or contract) between Ayata Homes and the client.
3. Consultations & Enquiries
Submission of a consultation form or contacting us via phone, email, or WhatsApp does not constitute a binding agreement or guarantee of service. A project engagement begins only upon execution of a signed proposal and receipt of the agreed advance payment.
We reserve the right to decline any project at our sole discretion.
4. Pricing & Payments
- All prices are quoted in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise.
- Quoted prices are valid for the period specified in the proposal. Prices are subject to revision if the project scope changes after the quote is issued.
- Payment schedules (advance, milestone, and final payments) are outlined in the project proposal or agreement.
- Delayed payments may result in project pauses or additional charges as specified in the agreement.
5. Client Responsibilities
As a client, you agree to:
- Provide accurate and complete information required for the design and execution process.
- Ensure timely access to the property for site visits and execution work.
- Review and approve design concepts, materials, and 3D visualisations within the timelines agreed upon.
- Communicate change requests in writing in a timely manner.
6. Design Ownership & Intellectual Property
All design concepts, drawings, mood boards, 3D renderings, and creative work produced by Ayata Homes remain the intellectual property of Ayata Homes until full payment has been received. Upon full payment, the client is granted a non-exclusive licence to use the designs for the specific project.
Ayata Homes retains the right to use photographs and details of completed projects for portfolio, marketing, and promotional purposes unless the client objects in writing.
7. Warranty
Ayata Homes provides a 1-year service warranty on workmanship from the date of project handover. This warranty covers defects arising from our work and does not cover damage caused by misuse, neglect, or third-party modifications.
Warranty terms for specific materials and products are subject to the respective manufacturer's warranty and are separate from our service warranty.
8. Changes & Cancellations
- Changes to project scope after agreement execution may result in revised timelines and additional charges.
- Cancellation of a project after work has commenced may result in forfeiture of the advance payment and any costs incurred up to that point.
- Both parties may terminate the agreement by providing written notice, subject to the terms outlined in the project contract.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Ayata Homes shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services or any project-related matter. Our total liability shall not exceed the amount paid by you for the specific project in question.
10. Governing Law
These Terms are governed by and construed in accordance with the laws of Karnataka, India. Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts of Bengaluru, Karnataka.
11. Amendments
We reserve the right to update or modify these Terms at any time. Changes will be effective upon posting to this page with an updated "Last Updated" date. Continued use of our services after any changes constitutes your acceptance of the revised Terms.
